Maryland

As of January 1, 2025, Maryland requires hospitals to establish and maintain protocols
and capacity to provide appropriate, evidence-based interventions that reduce the risk
of subsequent harm and fatality following an opioid-related overdose or opioid-related
emergency medical condition.
Specifically, the requires hospitals to:
- Establish protocols to manage opioid-related emergencies, including:
  - - Provide evidence-based interventions to reduce future harm following
      an overdose
    - Stock at least one FDA-approved opioid agonist for opioid use disorder
      (OUD) treatment.
    - Offer OUD medication if recommended by the practitioner and
      voluntarily accepted by the patient
- Protocols must ensure:
  - Compliance with prescribing requirements.
  - Standardized screening, diagnosis, and treatment for OUD.
  - Identification and referral to community-based treatment.
- Before discharge, hospitals must refer patients for ongoing treatment or provide
  support to help them access care.
